1. Agreement to Terms

By accessing or using the PixelGem Zone platform located at northpixelzone.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and PixelGem Zone. If you do not agree to these Terms, you must not access or use the Service. We may update these Terms from time to time, and your continued use of the Service after any such changes constitutes your acceptance of the revised Terms. The platform is designed purely for entertainment and social engagement purposes. No monetary value is assigned to any in-platform items, scores, achievements, or virtual elements. There is no purchase required to access or use any feature of the Service. PixelGem Zone does not offer, facilitate, or involve any financial transactions, monetary exchanges, or transfers of value of any kind. All content, features, and interactive experiences on the platform are provided entirely free of charge. The Service is intended to be a fun and engaging social entertainment experience for adult users in Canada who enjoy puzzle and arcade-style interactive content.

3. Eligibility

You must be at least 19 years of age and a resident of Canada to use the PixelGem Zone platform. By accessing and using the Service, you represent and warrant that you meet these eligibility requirements. 6. Intellectual Property

The Service and its entire contents, features, and functionality, including but not limited to all information, software, text, displays, images, graphics, video, audio, design, selection, and arrangement thereof, are owned by PixelGem Zone, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. The PixelGem Zone name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of PixelGem Zone. You must not use such marks without our prior written permission. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only. Any unauthorized reproduction, distribution, modification, or use of any materials on the Service is strictly prohibited.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER PIXELGEM ZONE NOR ANY PERSON ASSOCIATED WITH PIXELGEM ZONE MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICE. WITHOUT LIMITING THE FOREGOING, NEITHER PIXELGEM ZONE NOR ANYONE ASSOCIATED WITH PIXELGEM ZONE REPRESENTS OR WARRANTS THAT THE SERVICE, ITS CONTENT, OR ANY SERVICES OBTAINED THROUGH THE SERVICE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS. TO THE FULLEST EXTENT PROVIDED BY LAW, PIXELGEM ZONE HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PIXELGEM ZONE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE, OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if PixelGem Zone has been advised of the possibility of such damage. If any limitation on remedies, damages, or liability is prohibited or restricted by law, PixelGem Zone shall remain entitled to the maximum disclaimers and limitations available under applicable law.

9. Indemnification

You agree to defend, indemnify, and hold harmless PixelGem Zone, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms, your use of the Service, including but not limited to any use of the Service's content and features other than as expressly authorized in these Terms, or your use of any information obtained from the Service. This indemnification obligation will survive the termination of these Terms and your use of the Service.

10. Privacy Policy Reference

Your use of the Service is also governed by our Privacy Policy, which is available at Privacy Policy. Our Privacy Policy explains how we collect, use, and protect your personal information in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy legislation. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the courts of the Province of Ontario, Canada, and you consent to the personal jurisdiction of such courts. If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
